Popular Halloween Candy Now Comes with a Disclaimer
When I ask people what their favorite candy is, usually the answer is the same. Reeses Peanut Butter Cups. That is, if you aren't allergic to peanuts, obviously. If you look at some of the polls that have been taken recently, you will mostly get the same answer. Although there was one poll that was taken where the survey came up with Minnesota's favorite candy was Mike and Ikes. What the heck???
THIS CANDY IS AMONG THE MOST POPULAR CANDY IN THE NATION
Anyway, I love Reeses penut butter cups. However, I am also extremely picky when it comes to that candy. I usually only get the holiday ones. No matter what holiday it is. Why? Because those are usually guaranteed fresh. If a Resses peanut butter cup sits for too long on the shelf, it gets weird, stale, and something you probably won't want to eat. Or, that might just be me.
Even though I am picky, I certainly wouldn't do this - complain or even sue because the picture on the front didn't reflect what was inside the picture, exactly.
SOME PEOPLE JUST LOOK FOR ANYTHING TO TRY AND MAKE A FAST BUCK
The Lawsuit: Florida residents Nathan Vidal and Eduardo Granados filed a $5 million class-action lawsuit against Hershey, claiming the packaging was deceptive because the chocolate pumpkins did not feature the carved jack-o'-lantern eyes and mouths shown on the wrapper.
THE OUTCOME ON THIS CASE WAS JUSTIFIED
Luckily, the judge dismissed the case because it was ridiculous. Although, the official ruling stated that the plaintiffs failed to prove a financial loss and suffered only "subjective disappointment"
THE RULING IN HERSEY'S FAVOR - DISCLAIMER STILL PUT ON PACKAGE
The ruling just came down for the second time in September of this year. Even though the ruling went in Hershey's favor, the disclaimer is now on the package. What is the actual issue? The chocolate peanut butter pumpkins have a carving like a jack-o-lantern on the package, while the actual pumpkins do not have that carving. My opinion - why does this matter?? Some people are so strange as to what they get all upset over. Its not a big deal. Besides, you eat the thing, it's not for decoration. If it tastes bad, then that is something to complain about, not if the picture doesnn't absolutely represent what is inside.
You can check out the video of how they came to this disclaimer decision here.
Anyway, there is your frivolous lawsuit for the day.
