FOLEY -- A Willmar man won't face any additional jail time for choking a St. Cloud taxi driver back in March.

Twenty-three-year-old Zachary DeGraw pleaded guilty to one misdemeanor count of 5th degree assault back in May.

He was charged with assault motivated by bias because the driver was Muslim, and another assault charge but those were dismissed as part of a plea agreement.

A Benton County judge has sentenced him Thursday to 90 days in jail, however he stayed all but six days.

Degraw gets credit for the six days already served. He will not face any additional jail time as long as he doesn't violate his two year probation.

Degraw must also pay restitution of almost $1,400, take an anger management course and other conditions.
